2. Terms and Legal Foundations
2.1 Terms
Personal data refers to any information relating to an identified or identifiable person. A data subject is a person whose personal data is being processed. Processing includes any handling of personal data, regardless of the methods and procedures used, particularly storing, disclosing, obtaining, collecting, deleting, saving, modifying, destroying, and using personal data.
The European Economic Area (EEA) includes the European Union (EU) as well as the Principality of Liechtenstein, Iceland, and Norway. The General Data Protection Regulation (GDPR) refers to the processing of personal data as the processing of personal information.
2.2 Legal Foundations
We process personal data in accordance with Swiss data protection law, particularly the Federal Act on Data Protection (FADP) and the Ordinance to the Federal Act on Data Protection (OFADP). If and to the extent that the General Data Protection Regulation (GDPR) applies, we process personal data based on at least one of the following legal foundations:
Article 6(1)(b) GDPR for the necessary processing of personal data to fulfill a contract with the data subject or to carry out pre-contractual measures.
Article 6(1)(f) GDPR for the necessary processing of personal data to protect our legitimate interests or those of third parties, provided that the fundamental rights and freedoms as well as the interests of the data subject do not outweigh them. Legitimate interests include, in particular, our interest in providing our services in a permanent, user-friendly, secure, and reliable manner, promoting them when necessary, ensuring information security and protection against misuse and unauthorized use, enforcing our legal claims, and complying with Swiss law.
Article 6(1)(c) GDPR for the necessary processing of personal data to comply with a legal obligation to which we are subject under applicable laws of EEA member states.
Article 6(1)(e) GDPR for the necessary processing of personal data to carry out a task in the public interest.
Article 6(1)(a) GDPR for the processing of personal data based on the consent of the data subject.
Article 6(1)(d) GDPR for the necessary processing of personal data to protect vital interests of the data subject or another natural person.
3. Type, Scope, and Purpose
We process the personal data necessary to ensure that our activities and operations are carried out in a permanent, user-friendly, secure, and reliable manner. Such personal data may particularly fall into the categories of inventory and contact data, browser and device data, content data, metadata and usage data, location data, sales data, as well as contract and payment data.
We process personal data for the duration required for the respective purpose(s) or as legally required. Personal data that is no longer necessary will be anonymized or deleted.
We may have personal data processed by third parties. We may process personal data jointly with third parties or transfer it to third parties. Such third parties primarily include specialized service providers whose services we utilize. Even in such cases, we ensure data protection compliance.
We generally process personal data only with the consent of the data subject unless processing is permitted for other legal reasons. Processing without consent may be lawful, for example, to fulfill a contract with the data subject and to carry out pre-contractual measures, to protect our overriding legitimate interests, if processing is apparent from the circumstances, or after prior notification.
In this context, we particularly process information that a data subject voluntarily provides when contacting us – for example, via postal mail, email, instant messaging, contact form, inquiry form, social media, or phone – or when registering for a user account. We may store such information in an address book, a Customer Relationship Management (CRM) system, or similar tools. If we receive data about other individuals, the persons providing the data are obligated to ensure data protection for those individuals and to guarantee the accuracy of the personal data.
We also process personal data that we obtain from third parties, collect from publicly accessible sources, or gather in the course of our activities and operations, provided such processing is legally permissible.
Personal data from job applications is processed only to the extent necessary to assess suitability for employment or to later execute an employment contract. The personal data required for processing a job application is determined by the requested or provided information, for example, within a job advertisement. Applicants have the option to voluntarily provide additional information relevant to their applications.
4. Personal Data Abroad
We generally process personal data in Switzerland and the European Economic Area (EEA). However, we may also export or transfer personal data to other countries, particularly for processing or having it processed there.
We may export personal data to all countries and territories on Earth as well as elsewhere in the universe, provided that the law in those locations ensures adequate data protection according to the assessment of the Federal Data Protection and Information Commissioner (FDPIC) or by decision of the Swiss Federal Council, and – if and to the extent that the General Data Protection Regulation (GDPR) is applicable – by decision of the European Commission.
We may transfer personal data to countries whose laws do not ensure adequate data protection, provided that data protection is ensured for other reasons, particularly based on standard data protection clauses or other suitable safeguards. In exceptional cases, we may export personal data to countries without adequate or appropriate data protection if the specific data protection requirements are met, such as the explicit consent of the data subjects or a direct connection with the conclusion or execution of a contract. Upon request, we are happy to provide data subjects with information about any safeguards or supply a copy of the safeguards.
5. Rights of Data Subjects
Data subjects whose personal data we process have rights in accordance with Swiss data protection law. These include the right to access, as well as the right to rectification, deletion, or blocking of the processed personal data.
Data subjects whose personal data we process may – if and to the extent that the General Data Protection Regulation (GDPR) is applicable – request free confirmation of whether we are processing their personal data. In this case, data subjects may request information about the processing of their personal data, restrict the processing of their personal data, exercise their right to data portability, and have their personal data rectified, deleted (“right to be forgotten”), blocked, or completed.
Data subjects whose personal data we process may – if and to the extent that the GDPR is applicable – revoke their given consent at any time with future effect and object to the processing of their personal data at any time.
Data subjects whose personal data we process have the right to lodge a complaint with the relevant supervisory authority. The supervisory authority for data protection in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC).
6. Data Security
We implement appropriate technical and organizational measures to ensure data security that is proportionate to the respective risk. However, we cannot guarantee absolute data security.
Access to our website is secured using transport encryption (SSL/TLS, particularly with Hypertext Transfer Protocol Secure, abbreviated HTTPS). Most browsers indicate transport encryption with a padlock symbol in the address bar.
Our digital communication is subject – as is all digital communication in principle – to mass surveillance without cause or suspicion, as well as other forms of monitoring by security authorities in Switzerland, the rest of Europe, the United States of America (USA), and other countries. We have no direct influence over the corresponding processing of personal data by intelligence agencies, law enforcement authorities, and other security institutions.
7. Use of the Website
This website is hosted by Swissaround – Markus Manfredi Photography. Swissaround – Markus Manfredi Photography collects personal data when you visit this website. This includes:
- Information about your browser, network, and device
- Websites you visited before accessing this website
- Pages you visit on this website
- Your IP address
Swissaround – Markus Manfredi Photography requires this data to operate this website, as well as to protect and improve its platform and services. Swissaround – Markus Manfredi Photography analyzes the data in a depersonalized form.
7.1 Cookies
We may use cookies. Cookies – both first-party cookies (our own) and third-party cookies (from services we use) – are data stored in the browser. Such stored data is not necessarily limited to traditional text-based cookies.
Cookies can be stored in the browser temporarily as “session cookies” or for a specific duration as so-called persistent cookies. Session cookies are automatically deleted when the browser is closed. Persistent cookies have a defined storage period. Cookies make it possible to recognize a browser upon a user’s next visit to our website and, for example, measure the reach of our website. However, persistent cookies can also be used for online marketing purposes.
Cookies can be completely or partially disabled and deleted in the browser settings at any time. Without cookies, our website may no longer be fully functional. We actively request explicit consent for the use of cookies – at least when and where required.
For cookies used for performance and reach measurement or advertising, a general opt-out is possible for numerous services through AdChoices (Digital Advertising Alliance of Canada), the Network Advertising Initiative (NAI), YourAdChoices (Digital Advertising Alliance), or Your Online Choices (European Interactive Digital Advertising Alliance, EDAA).
7.2 Privacy Policy for SSL/TLS Encryption
This website uses SSL/TLS encryption for security reasons and to protect the transmission of confidential content, such as inquiries you send to us as the website operator. You can recognize an encrypted connection by the fact that the browser’s address bar changes from “http://” to “https://” and by the padlock symbol in your browser’s address bar.
When SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.
7.3 Server Log Files
We may collect the following data for each access to our website, provided that it is transmitted by your browser to our server infrastructure or can be determined by our web server: date and time, including time zone; Internet Protocol (IP) address; access status (HTTP status code); operating system, including user interface and version; browser, including language and version; accessed individual subpages of our website, including transferred data volume; and the last webpage accessed in the same browser window (referrer).
We store such data, which may also constitute personal data, in server log files. This information is necessary to provide our website in a permanent, user-friendly, and reliable manner and to ensure data security, particularly for the protection of personal data, including through third parties or with the assistance of third parties.
7.4 Tracking Pixels
We may use tracking pixels on our website. Tracking pixels are also referred to as web beacons. These are small, usually invisible images that are automatically retrieved when visiting our website, including those from third parties whose services we use.
Tracking pixels can collect the same data as server log files.
8. Notifications and Communications
We send notifications and communications via email and other communication channels, such as instant messaging or SMS.
8.1 Performance and Reach Measurement
Notifications and communications may contain web links or tracking pixels that record whether an individual message was opened and which web links were clicked. Such web links and tracking pixels may also track the use of notifications and communications on a personal basis. We require this statistical tracking for performance and reach measurement to ensure that notifications and communications are sent effectively, user-friendly, and in a way that meets the needs and reading habits of recipients, as well as to maintain long-term, secure, and reliable communication.
8.2 Consent and Objection
You must generally provide explicit consent for the use of your email address and other contact details unless such use is permitted on other legal grounds. Whenever possible, we use the “double opt-in” procedure, meaning you will receive an email with a web link that you must click to confirm your subscription. This ensures that no unauthorized third party can misuse your information. For proof and security reasons, we may log such consents, including the Internet Protocol (IP) address, date, and time.
You may generally object to receiving notifications and communications, such as newsletters, at any time. By doing so, you may also object to the statistical tracking of usage for performance and reach measurement. However, necessary notifications and communications related to our activities and operations remain unaffected.
8.3 Service Providers for Notifications and Communications
We send notifications and communications with the help of specialized service providers.
In particular, we use: Mailchimp, Squarespace, Monday, and Acuity Scheduling.
Mailchimp: Communication platform; provider: The Rocket Science Group LLC DBA Mailchimp (USA), a subsidiary of Intuit Inc. (USA); data protection information: Privacy Policy (Intuit) including “Country and Region-Specific Terms”, “Frequently Asked Questions on Mailchimp Data Protection“, “Mailchimp and European Data Transfers“, Security, Cookie Policy, “Privacy Rights Requests“, and Legal Terms.
9. Social Media
We are present on social media platforms and other online platforms to communicate with interested individuals and provide information about our activities and operations. In connection with such platforms, personal data may also be processed outside of Switzerland and the European Economic Area (EEA).
The general terms and conditions (GTC), terms of use, privacy policies, and other provisions of the respective platform operators apply. These provisions specifically inform data subjects about their rights directly with the respective platform, including, for example, the right to access their data.
10. Performance and Reach Measurement
We use services and programs to analyze how our online offering is used. In this context, we can measure, for example, the success and reach of our online presence as well as the impact of third-party links to our website. Additionally, we may test and compare how different versions or sections of our online offering are used (“A/B testing method”). Based on the results of performance and reach measurement, we can correct errors, enhance particularly popular content, or implement improvements to our online offering.
When using services and programs for performance and reach measurement, the Internet Protocol (IP) addresses of individual users must be stored. IP addresses are generally shortened to comply with the principle of data minimization and to enhance the privacy of visitors to our website through pseudonymization (“IP masking”).
The use of services and programs for performance and reach measurement may involve the deployment of cookies and the creation of user profiles. User profiles may include visited pages or viewed content on our website, information about screen size or browser window dimensions, and at least an approximate location. In principle, user profiles are created exclusively in a pseudonymized manner. We do not use user profiles to identify individual visitors to our website. Some services where you are logged in as a user may be able to associate the usage of our online offering with your profile on that service, provided that you have given prior consent for such an association.
We specifically use:
Google Ads: This website uses Google Conversion Tracking. If you have accessed our website via a Google advertisement, Google Ads will place a cookie on your computer. The conversion tracking cookie is set when a user clicks on a Google ad. These cookies expire after 30 days and are not used for personal identification. If the user visits certain pages on our website while the cookie is still valid, we and Google can recognize that the user clicked on the ad and was redirected to that page. Each Google Ads customer receives a different cookie, so cookies cannot be tracked across the websites of different Ads customers. The information collected through the conversion cookie is used to generate conversion statistics for Ads customers who have opted into conversion tracking. These customers learn the total number of users who clicked on their ad and were redirected to a page containing a conversion tracking tag. However, they do not receive any information that could personally identify users.
If you do not wish to participate in tracking, you can refuse the placement of the required cookie—for example, by adjusting your browser settings to generally disable the automatic setting of cookies or by configuring your browser to block cookies from the domain “googleleadservices.com.”
Please note that you must not delete the opt-out cookies as long as you do not want measurement data to be collected. If you delete all cookies in your browser, you must set the respective opt-out cookie again.
Google Analytics: Performance and reach measurement; provider: Google LLC (USA) / Google Ireland Limited (Ireland) for users in the European Economic Area (EEA) and Switzerland; Data protection information: Measurement also across different browsers and devices (cross-device tracking) and with pseudonymized Internet Protocol (IP) addresses, which are only exceptionally transmitted in full to Google in the USA. For more details, see: Privacy and Security Principles, Privacy Policy, Privacy Guide for Google Products (including Google Analytics), How Google Uses Data from Sites or Apps That Use Our Services, How Google Uses Cookies, Browser Add-on to Disable Google Analytics, Personalized Ads Settings (Enable/Disable/Manage Preferences).

Google Tag Manager itself does not collect any data. The tags that collect data and are managed via Google Tag Manager are listed in this privacy policy.
Site Kit: Site Kit is a WordPress plugin developed by Google that provides various tools and information from Google on a website. It offers website owners useful features to optimize their website and improve its performance.
Google Web Fonts: This website uses so-called web fonts provided by Google to ensure a uniform display of fonts. When you access a page, your browser loads the required web fonts into its cache to display text and fonts correctly. If your browser does not support web fonts, a standard font from your computer will be used. For more information about Google Web Fonts, please visit: https://developers.google.com/fonts/faq and refer to Google’s privacy policy: https://www.google.com/policies/privacy/.
